Law correspondent, Lucknow. In an important decision, the Lucknow bench of Allahabad High Court has quashed the entire criminal case against businessman Nikant Jain related to allegations of illegal extortion and corruption.
The case pertained to the approval of a proposed solar power project, in which allegations of bribery were allegedly sought. The court clarified that there is no concrete evidence available on record which would prima facie constitute a crime. This order was passed by the single bench of Honorable Justice Rajeev Singh on the petition of Nikant Jain.
The court said in its decision that prima facie no offense is made out in the case under the Indian Justice Code and Prevention of Corruption Act. Along with this, the court also canceled the charge sheet filed on May 15, 2025 and the summoning order dated May 17, 2025.
The court also said in its decision that the complainant himself has admitted that the complaint was filed on the basis of misunderstanding. The FIR in the case was registered on March 20, 2025, at the Gomti Nagar police station in the capital, based on a complaint sent to the Chief Minister by a representative of a company. It was alleged in the complaint that five percent of the project cost was demanded as bribe for the approval of the solar power project.
On behalf of Nikant Jain, it was argued that the allegations are vague, without evidence and the result of business rivalry and administrative confusion. It was also argued that neither any amount of money was given, nor any property or valuable security was handed over, nor was there any threat to be made.
It was also said that no map-view was made during the investigation and no recovery of the alleged cash of Rs 1 crore was made. The Court also found that there was no evidence on record to prove that the accused had offered undue favors to any public servant.
