Allahabad High Court, in an important order, has directed the Principal Secretary (Basic Education) to investigate and remove all such teachers who have obtained jobs by fraud within six months. The court has said that after a detailed investigation, everyone should be removed as per the law. Also, strict disciplinary and punitive action should be taken against the officers found involved in this. Justice Manju Rani Chauhan has given this order while rejecting the petition of Deoria’s assistant teacher Garima Singh. When fraud was found, the appointment of the petitioner was canceled in August 2025.

The Court said, in order to maintain the rule of law, protect the larger public interest and ensure that the education imparted to children is not compromised, the Court has no option but to direct the Principal Secretary, Basic Education, to conduct a comprehensive and time-bound inquiry into the appointments of assistant teachers.

Justice commented, This Court has repeatedly observed a disturbing pattern in the exercise of its extraordinary powers under Article 226 of the Constitution of India. In this, a large number of assistant teachers have obtained appointment by using forged and fake certificates, fake documents or deliberately hiding important facts. Such persons remain in service for years, in open collusion with the institution management and in many cases with the active connivance or tacit approval of the Basic Education Officer concerned. According to the brief facts related to the case, the petitioner was appointed assistant teacher on 27 July 2010.

Had taken charge in Higher Primary School, Bardiha Dalpat, Development Block- Salempur, District- Deoria. BSA canceled his appointment in the order passed on August 6, 2025. This was challenged in the High Court. On behalf of the petitioner it was said that all the documents were examined. Almost 15 years of service.

On behalf of the defendant BSA, it was said that all the documents presented at the time of appointment were found to be fake. The petitioner was given due notice on July 2, 2025, to which no reply was received nor was any document presented to prove that the educational certificate, domicile certificate and other related documents presented at the time of appointment are genuine.

The appointment has been made using the educational documents and domicile certificate of another candidate named Garima Singh. The court has directed the Registrar (Compliance) to send a copy of the order to the concerned authorities.
